Warranty conditions

BY PURCHASING A PRODUCT IN OUR STORE, YOU AGREE TO THE FOLLOWING

RECOMMENDATIONS FOR CARE AND ORDER/CONDITIONS OF USE, AS WELL AS THE WARRANTY CONDITIONS FOR THE SHOES.

Warranty period

Warranty is provided for a period of 2 years from the date of purchase for new shoes purchased on the site Italy-sale.com. The warranty period starts from the date indicated on the receipt or other document confirming the purchase on Italy-sale.com.

WARRANTY OBLIGATIONS

  1. This warranty applies solely to latent defects arising from the manufacturing process of the Goods and does not include damage caused by natural wear and tear or improper use of the goods. The warranty entitles the Buyer to repair the Goods free of charge, provided that the defect occurred during the warranty period.

1.1 The warranty does not cover defects visible at the time of purchase.

1.2 Defects inherent in footwear are defects that impair its usability and (or) prevent the footwear from being used for its intended purpose.

  1. The method of repair of the Goods (elimination of the defect) is determined at the discretion of the Seller.

2.1 If the Seller considers that the repair is impossible, the Seller reserves the right to replace the defective part or the whole Goods with the same or similar goods from the Seller's stock, reduce the price of the Goods or terminate the Contract.

2.2 The Seller's liability for damages arising out of this warranty shall be limited to the value of the Goods purchased by the Buyer.

2.3 Natural leather, suede, nubuck may have scars, texture irregularities, wrinkles of natural origin, which are evidence of the natural origin of these materials and are not a reason for warranty claims.

  1. WARRANTY EXCLUSIONS:

The warranty is NOT EXCLUDED for the following:

3.1 Natural wear and tear of the footwear.

3.1.1. Wear of soles, heels and heels.

3.1.2 Wear and tear of the back of the shoe during prolonged wear or rubbing of the shoe against the skin of the foot or clothing.

3.1.3. Heel abrasion.

3.1.4 Wear (rubbing) of the socks of the shoe by contact with surfaces in the course of normal use.

3.1.5 Change in shape or loss of rigidity of the backs, allies, as a result of repeated bending of shoes during walking.

3.1.6 Rubbing (wear and tear) of the shoe lining, insole lining, insoles, is considered to be natural wear and tear and is not a reason for warranty claim.

3.2 Any mechanical damage to the shoes, such as cuts, punctures, cracks, caused by external factors and not manufacturing defects.

3.3 Damage caused by improper use of the footwear, such as wearing in conditions for which the footwear is not designed (sports loads for non-sports models).

3.4 Negative environmental effects, including humidity, temperature variations, exposure to sunlight or chemicals (salts, chemicals, oil, etc.).

3.4.1 Wearing shoes in snowy weather may cause salt and other chemicals used by utilities to accelerate snowmelt to settle on the surface of the shoes. The resulting stains and marks on the shoes cannot be the basis for warranty claims.

3.5 Changes in color or shape of materials due to “natural aging”.

3.6 Discoloration of the shoe due to water, sweat or chemical cleaning agents.

3.7. “Creases and wrinkles” on the surface of the shoe that result from natural bending of the shoe during use.

3.7.1 The transfer of lining color to socks or feet is not a manufacturing defect and is not cause for warranty recourse.

3.8 Improper care and use.

3.8.1 Improper shoe care, including the use of inappropriate products to clean or protect the shoe materials.

3.8.2. Damage caused by violation of the rules of care and operation specified in this instruction (warranty card).

3.8.3 Defects resulting from the use of footwear in conditions of high humidity or excessive mechanical impact.

3.8.4. Damage caused by excessive effort to tighten the laces or shoeing already laced shoes.

3.9 Improper Footwear Selection

3.9.1 It is necessary to choose shoes according to your size and fullness, taking into account individual features - the foot in shoes should not be compressed. Incorrectly sized or full-fitting footwear is not a reason to file a claim.

3.9.1 Deformation of footwear, tearing of seams, cracks and creases due to incorrectly sized or full-fitting footwear is not a warranty case

3.10. Self-repair and modification.

3.10.1 Any damage or defects resulting from self-repair, modification of footwear or changes in the design of the product.

3.10.2 The use of “other parts” (not original), insoles, laces or elements, in this model of shoes.

3.11. Minor defects and accessories and decorative elements

3.11.1 Wear, tearing off of decorative elements, such as logos, prints, stickers, as well as any decorative inserts, decorative laces, fittings that do not affect the functional qualities of the shoes is not a warranty case.

3.11.2 Damage to the laces is not a warranty case.

3.12. The documents specified in clause 10.2. have traces of corrections, adjustments; the order number or date of sale or cost of goods in the documents specified in clause 10.2. do not coincide with the data contained in the Seller's database on sales.

3.13. Shoes sent for repair do not correspond (are not identical) to the name / model of shoes specified in the documents listed in paragraph 10.2. or do not match the number / article specified in the documents listed in paragraph 10.2. In the case of impossibility to identify the markings on the shoes or in its absence on the shoes, for the basis of compliance with the model is considered the visual identity of the shoes (full visual coincidence) with the model posted on the site Italy-sale.com.

  1. CONDITIONS AND PROCEDURE FOR THE SELECTION AND USE OF FOOTWEAR

4.1. SELECTION OF FOOTWEAR

When buying shoes, pay great attention to the correct choice of the required shoe size, because in case of mismatch between the size of the shoe and the foot, problems may arise: on the one hand, the wrong choice jeopardizes the health of the feet, and on the other hand - it may lead to deformation of the shoes, tearing seams, cracks and creases.

4.2 It is necessary to choose shoes according to your size and fullness, taking into account individual characteristics - the foot in shoes should not be compressed. Incorrectly sized or full-fitting shoes are not a reason to file a claim.

4.3 When choosing shoes, pay attention to the purpose of footwear (work, leisure, model, casual, sports, etc.). The shape and height of the heel should match the physique of the consumer.

4.4 At first, wear shoes for a short period of time, so that they can adapt to the shape of the foot. At work wear shoes comfortable, sturdy, with a heel height of 30 - 40 mm, taking into account the age.

Fashion shoes are intended for short-term wear for going out;

  1. CARE AND USE

5.1 After each wear, keep the shoes in good condition:

clean them from dust and dirt. In case of grease, use 1 -

2% soap solution by applying it to the shoe with a sponge. This will prolong

the service life of the shoe;

5.2 Dry wet shoes at room temperature without using heating and heating devices, heat sources, avoiding direct sunlight and using internal inserts-frames to maintain the shape of the shoes;

5.3 Shoe shoes only unlaced (unbuttoned), use shoe horns - this will help prevent tearing of the back seam and maintain the shape of the shoe;

do not remove shoes without unbuckling or stepping on the back - this will prevent the sole from tearing off;

5.4 Do not wear shoes with leather soles and fabric uppers in rainy weather. Wetting of such shoes is not a reason to file a claim;

5.5 Do not wear shoes with high heels, thin soles on puddles, gravel, gravel, rubble, paving stones, as this may cause damage to the shoes or injury.

5.6 Model shoes are intended to be worn provided that the surface is flat, hard.

5.8. Handle the decorative hardware on the shoes with care; Do not overtighten the laces at the ankle joint to prevent tearing of the leather and fastenings.

  1. Shoe Storage.

6.1 Shoes and leather goods should be stored at a temperature not lower than

+14°C and not higher than +25°C at a relative humidity of 50%.

6.2 The distance from the outer walls of the room, heating and heating devices should be at least 1.0 m. Footwear and leather goods should be protected from direct sunlight, steam, gases and chemicals (alkalis, acids, active solvents, etc.).

  1. CARE OF LEATHER SHOES 

7.1 It is forbidden to wash or wash shoes. 

7.1 After removing the shoes clean them from dust and dirt with a brush or a soft cloth. In order for shoes to keep their beautiful appearance for a long time, do not let moisture in and do not lose their shape, use quality special shoe care products (cream, apretura, polish, etc.). It is also necessary to avoid exposure of shoes to alkalis, acids, active solvents, detergents.

  1. CARE OF PATENT LEATHER, COATED LEATHER SHOES

8.1 These shoes require special care as they cannot tolerate temperatures below zero degrees Celsius. 

8.2 Wear shoes 10 minutes before going out to prevent frost damage. The heat of your foot will be transferred to the shoe, so it will cool down slowly, not immediately. This will prevent cracks from forming. It is not recommended to use such shoes at temperatures below zero degrees Celsius. After removing the shoes, clean them from dust and dirt with a damp soft cloth, then wipe the shoes with a dry cloth.

  1. CARE OF SHOES MADE OF SUEDE AND VELOUR. 

9.1 If the shoes are dirty, remove dirt with a special brush or sponge (if necessary, dry the shoes naturally), treat the shoes with a special product for cleaning suede and nubuck.

9.2 The surface of the shoe should not be rubbed hard, because the outer fibers may be damaged and the material will lose its properties.

  1. WARRANTY CLAIM PROCEDURE

10.1 In case of a defect falling under the warranty conditions, the buyer is obliged to report it within 14 days from the date of its discovery under the risk of expiry of rights under this warranty by e-mail to support@italy-sale.com.

10.2 In order to process the claim, the buyer must provide: 

- This warranty card;

- Proof of purchase (proof of payment) 

- A copy of the e-mail from Italy-sale.com that confirms the purchase and contains the order number; 

- A photo and a description of the defect of the shoe

- 2 photos of the “general view” of the pair of shoes from different sides.


10.3 The Seller undertakes to consider the preliminary request within 14 working days from the moment of receipt of all the necessary documents specified in clause 10.2.

10.4 In case the Seller decides that the defect falls under the warranty, the Seller shall send the shoes to the address specified in the e-mail in the response to the complaint.

10.5 The Seller undertakes to consider the claim within 14 working days after receipt of the shoes.

In case the defect is confirmed and falls under the warranty, the Seller offers the following options:

   - Repair of the footwear (if the defect is repairable).

   - Replacement of the goods with the same or similar goods from the Seller's stock (if repair is impossible or inexpedient).

   - Refund of the cost of the goods (if repair or replacement is not possible).

  1. CONSUMER RIGHTS.

11.1 This warranty card is provided in accordance with the requirements of the Consumer Protection Act of the Republic of Poland and the Civil Code of the Republic of Poland. It does not limit the consumer's rights to protection of his interests provided by law, but supplements them within the terms and conditions set out above.


Lorenzo Leone Gruppo Sp.Zo.O. reserves the right to amend the warranty conditions in accordance with changes in legislation and internal company policy.


Additional warranty rules

against through wiping of external parts of the shoe upper


Appendix №1 to the Warranty Card

for footwear TM “Lorenzo Leone”, “Vicenzo Morelli”

This section defines the rules of the additional warranty “7 years” against through wiping of the outer parts of the shoe upper  

(Shoe upper is the outer side of the structural element of the shoe attached to the sole    

- designation and description of footwear uppers in accordance with EU Directive 94/11/EU for a clearer understanding of what footwear uppers are).


 (hereinafter referred to as the “Additional Warranty”) for footwear of TM “Lorenzo Leone”, “Vincenzo Morelli”. 

  1. Seller's warranty obligations for the Additional Warranty:

1.1. The Seller provides the Buyer with new shoes of the brand “Lorenzo Leone”, “Vincenzo Morelli” purchased on the website Italy-sale.com and marked “StS”, (hereinafter referred to as the Shoes) an additional guarantee against through wiping of the outer parts of the upper of the shoe from the inside of the shoe (from the middle of the shoe), due to contact of the toes with these parts during the operation of the shoe, which is valid for 84 months (7 years) from the date of sale of the Shoes.

  1. Terms of the Additional Warranty

2.1. The Additional Warranty applies exclusively to the footwear models marked “StS” on the Italy-sale.com website and refers to the following products:

Sneakers made of genuine leather (except for the products indicated in clause 2.1.1)

Sneakers made of genuine leather (except for the products specified in clause 2.1.1)

Loafers made of genuine leather (except for the articles specified in 2.1.1)

2.1.1. The Additional Warranty does NOT apply to footwear made of, or the upper of which has elements of:

Braided genuine leather;

Suede;

Nubuck;

Artificial leather;

ECO leather;

Fabric or woven material;

2.2. The Additional Warranty is maintained subject to: the Buyer's compliance with the rules of operation of the footwear specified in the Warranty Card; in the presence of the Warranty Card; an email from the Italy-sale.com website confirming the purchase and containing the order number and the mark “StS” in the name of the shoe model, this Appendix to the Warranty Card; a document confirming the purchase (payment) on the Italy-sale.com website. 

2.3 The Seller is released from the Warranty obligations for the Additional Warranty specified in clause 1.1 of this Appendix No. 1 under the following conditions:

2.3.1.  Through damage to the outer parts of the shoe upper did not occur as a result of rubbing the toes of the foot with these parts from the inside during the operation of the shoe, or in places of through damage the shoe has traces of contact with abrasive, milling, cutting or piercing objects (tools).

2.3.2. The warranty conditions specified in the Warranty Card for the footwear have been violated.

2.3.3. The documents specified in clause 2.2 have traces of correction, correction; the order number or date of sale or the cost of the goods in the documents specified in clause 2.2. do not match the data contained in the Seller's database on sales

2.3.4. The footwear sent for repair does not correspond (is not identical) to the name/model of the footwear specified in the documents listed in clause 2.2. or does not match the number/article specified in the documents listed in clause 2.2. If it is impossible to identify the marking on the shoe or in the absence of it on the shoe, the visual identity of the shoe (full visual match) with the model posted on the website Italy-sale.com is considered as the basis for model compliance.

2.4. The seller reserves the right to conduct an examination. If the examination establishes that the footwear has the characteristics specified in clauses 2.3.1; 2.3.2; 2.3.3; 2.3.4; this Appendix No. 1 to the Warranty Card, or the footwear has signs of counterfeiting, the Seller has the right to refuse warranty repair, and the Buyer is obliged to reimburse the Seller for the cost of the examination. 

2.5. If the defect in the footwear caused by the Manufacturer's fault cannot be eliminated, the Seller shall replace the footwear with the same product or a similar one from among those available from the Manufacturer (Seller).
